Pre-nuptial agreements, if properly drawn up and procedures followed, are often kept to by Judges. At worst, they are often kept to except for where they become unfair after some years of marriage or if they do not properly provide for any children. But, at the moment of writing this, the law does not say that they will definitely be followed.
There is another “but”!
The case of Radmacher was recently heard in the Supreme Court and many lawyers believe that when the decision is given out, it will make pre-nuptial agreements binding and thus “stand up”.
