Divorce rights

Myth
  Myth
“My wife refuses to discuss a separation agreement, so I believe my only option is to return home to force an agreement and the sale of the house. Am I entitled to return to the house? I left the property 6 months ago and there are 2 children involved.”
Fact
  Fact
Yes, you are legally entitled to live in the house as you are married and also, I imagine, it is in joint names.
But of course returning could cause significant upset and trouble. I am sure you will consider the effect of this on the children too. An alternative might be to pursue a divorce and apply to the Court for a sale.
