It is a myth to believe that a a party can automatically recover their initial deposit monies paid on the purchase of the house, especially where the parties are married and the house is in joint names, but it will depend on other factors, such as the length of the marriage and the financial resources and financial needs of the parties; there always needs to be justification to depart from equality but that will be determined against all the circumstances of the case.
