This will of course depend on the contents of any agreement. You should also realise that whilst Prenuptial Agreements are a legal agreement they are not automatically legally binding in the UK. They are, however, increasingly carrying more weight with courts. If they are properly drafted and both parties have received independent legal advice, they can be persuasive in future divorce proceedings. They can be taken into account so it is essential that legal advice is sought at the outset to ensure that they are drafted appropriately
